The conditions herein expressed are part of the contractual agreement to be established between Motoxplorers Lda. and its motorcycle rental clients (hirer).
1. MINIMUM RENTAL PERIOD
One day (24h) with any fraction considered as such.
2. DRIVERS LICENCE
A valid drivers licence must be presented by the hirer. This license must be valid through all the countries the hirer intends to ride the hired motorcycle.
3. AGE OF HIRER AND MINIMUM RIDING EXPERIENCE
20 years of age and at least one year of riding experience.
4. CONSUMABLES
The motorcycle is supllied with a full gas tank and must be returned by the hirer as such. The motorcycle will be supllied by Motoxplorers with tyres, brake pads and its general maintenance plan performed to withstand the hirer's planned itinerary.
5. INSURANCE
Prices include third party liability insurance valid in Portugal and Spain. However, it will always be the
responsibility of the hirer all damages caused to third parties or the rental vehicle when:
- The motorcycle is not riden by the person who is legally empowered to do so or authorized by MotoXplorers.
- The motorcycle suffers damage intentionally caused by the hirer or person for whom he is responsible.
- The motorcycle is riden by a person under the influence of alcohol, narcotics, drugs or even dementia.
- The motorcycle suffers vandalism, for example, damaged locks by attempted theft.
- The motorcycle is used in sporting events, rallys, races, challenges, contests, etc.
- There is an accident and the same is not reported in writing to MotoXplorers
in the earliest possible time.
On the event of lack of communication or late notification, the hirer will be fully responsible for the accident consequences on third parties and on the rented motorcycle.
6. DAMAGE TO THE RENTED MOTORCYCLE
The hirer is responsible to damages on the rental motorcycle only up to the amount of the mandatory deposit (see table here). The rented motorcycle will be checked for damage upon arrival. Cost of repair will be calculated by Motoxplorers, justified to the hirer and deducted from the deposit.
However, the hirer is fully responsibile for all damages to the rental vehicle when:
- The motorcycle is not riden by the person who is legally empowered to do so or authorized by MotoXplorers.
- The motorcycle suffers damage intentionally caused by the hirer or person for whom he is responsible.
- The motorcycle is riden by a person under the influence of alcohol, narcotics, drugs or even dementia.
- The motorcycle suffers vandalism, for example, damaged locks by attempted theft.
- The motorcycle is used in sporting events, rallys, races, challenges, contests, etc.
- There is an accident and the same is not reported in writing to MotoXplorers
in the earliest possible time.

7. PAYMENT
The estimated cost of the rental must be paid at the time of delivery of the motorcycle, along with a guarantee deposit (see table here). The cost of the rental may be paid in either cash, by Paypal or by Credit Card. The value of the guarantee deposit is returned at the end of the contract if the motorcycle is returned undamaged. The deposit may be made in cash or be assured as a Credit Authorization by the Credit Card company.
8. DELIVERIES AND PICKUP
These are free at MotoXplorers's headquarters in Rua Luis de Freitas Branco 26C, 1600-490 Lisboa, during working hours.
Motoxplorers can assure delivery or return of the motorcycle in the Lisbon area for a fee of 20,00 €.
9. RIDING OUTSIDE PORTUGAL
Liability insurance will cover riding in Portugal and Spain. Riding to other countries
may be authorized by MotoXplorers Lda, on payment of a fee, this being mentioned on the rental contract.
If the hirer intends to ride to other countries he is requested to inform his intention with two weeks advance so that MotoXplorers Ltd. can assure the necessary legal actions. If Motoxplorers becomes aware of an exit to an unauthorized country the hirer will be charged 3.00 euros per km traveled outside the contracted territory and will be responsible for all damage (to the rented motorcycle or third party) that may occur in this period .
10. TRAFFIC INFRACTIONS
The hirer assumes finantial and legal responsibility for all traffic infractions incurred on his rental motorcycle for the duration of his rental period.
11. RENTAL PERIOD
The lease ends on the day, time and place established on the rental contract.
If the hirer wants to extend the rental period he must contact MotoXplorers Ltd. with at least 24 hours advance. Motoxplorers may or may not authorize the extension of the rental period.
If Motoxplorers is unable to authorize the extension of the rental period and the motorcycle is not returned on the contractual term, its disapeaance will be reported to the authorities and punished under the traffic rules and Criminal Law.
12. ACCIDENTS
In case of accident the hirer shall proceed as follows:
- Call the authorities.
- Report the accident to Motoxplorers
- Get (s) other (s) driver (s) involved (s) in accident
details: name, address and telephone number, drivers license number, place and date of issue,
Make, model and registration of the vehicle involved,
Insurer and policy holder.
- Names and addresses of witnesses.
13. MECHANICAL FAILURE
In case of mechanical failure, the hirer must contact MotoXplorers Ltd with his accurate
location and
details about the failure.
Motoxplorers motorcycles are maintained to the highest standards but MotoXplorers Ltd. is not responsible for loss of time produced by accidents or mechanical failures that may slow or stop the hirer's holidays or travel plans.
14. DOCUMENTS
The MotoXplores delivery to the customer (lessee), a folder for this purpose, all documents
relate to the motorcycle.
In case of loss during the rental period sees the client as MotoXplorers
responsible for the loss. In this case you have to pay the sum of 60 euros for the application of new
documents.
It will also be the client (lessee) is responsible for payment of any fine, while
drive the motorcycle with the lack of them.
15. TRACKING
For safety reasons all motorcycles in MotoXplorers fleet are equiped with GPS tracking devices. Any attempt of disassembling or damage these devices will be reported to the authorities and punished under Criminal Law.
General Conditions to Motoxplorers Tour Participations
The conditions herein expressed are general, and conceived to rule the relation between Motoxplorers and its clients along conventional tours on which the client supplies his own motorcycle. Specific conditions will be set according to each tour destiny and should be dicussed, understood and acorded between Motoxplorers and its clients before each tour start. These General Conditions are ment to give Motoxplorer's clients an overview of the particular conditions they can expect on most of the tours. Don't hesitate to contact us with questions regarding the scope of the services we provide.
Non-responsibility
Motoxplorers can't be held responsible for any accident or loss, of any degree, resulting from any ocurrance during the tour, regardless of said ocurrances having been originated, caused by, or aggravated by the client, or even by guides, employees or partners of Motoxplorers, except in what the law will establish.
Motoxplorers reserves the right to make alterations or cancel the scheduled activities of a tour anytime a plausible security reason will demand so, namely, but not only, due to climatic changes, natural, political or social phenomenae and Acts of God.
Should a fact occur that will imply the cancellation or interruption of a tour or program, eventual costs resulting from further unforeseen travelling or even repatriation will not, in any case, be imputable to Motoxplorers.
Prices and Payments
The indicated prices include the services announced for the tour or program specified, and only those. Overnight stays at hotels are in shared double rooms. An extra fee will be charged for an upgrade to single room conditions. Sometimes, and after duly settled with the client or specified in the program, lodging may be done in different conditions.
Payment terms will be specified for each tour/program and must be respected. Delays may imply the charging of interests with rates according to Portuguese law. Regardless, delays over 30 days will not be acceptable. If the client decides to cancel his participation with 30 days notice to the tour/program start, Motoxplorers will keep 50% of the payments due to that date. With less than 30 days notice, Motoxplorers will keep 100% of the payments due to that date. Specific cancellation and no-show rules may be established for each of the tours/programs and will be informed to the client before any payment will be solicited.
Minimum participants per tour/program
Up to 20 days before each tour/program, Motoxplorers reserves the right to cancel said tour/program if a minimum quorum of participants isn't achieved. In that case, the client will be duly informed and reimbursed of 100% of his payments.
